These are the terms and conditions that Never Twice (ABN 92 576 656 998) (“Never Twice”, “our,”,”us”,”we”) provides access to the website www.nevertwice.com.au and rents Apparel to consumers.

1. Definitions.

In these terms and conditions:

(a) “Agreement” means these terms and conditions
(b) "Apparel" means all products offered as part of the Service.
(c) “Piece” means one item of Apparel
(d) "Rental Period" means the number of days that the Apparel is booked for commencing the day the Apparel is delivered to you and ceasing the day the Apparel must be posted back by you as nominated by you when booking the Apparel through the Site
(e) "Rental Price" means the cost of hiring the Apparel
(f) “RRP” means the recommended retail price of Apparel as displayed on the Site
(g) "Service" means rental of Apparel by Never Twice
(h) “Site” means the website located at nevertwice.com.au
(i) “Size Credit means store credit to the value of the Rental Price paid minus $25 which is a non-refundable processing fee for outfit cleaning, steaming and return shipping of subsequent outfit) which you can then use to hire another piece from Never Twice.
(j) "You" (or "your”) means any person using the Services or the Site

2. Acceptance.
(a) By using the Service through the Site you must indicate your acceptance of these terms and conditions.
(b) If you do not accept these terms and conditions you must cease using the Site immediately and our Service is not available to you.
(c) If you place a booking through this Site on behalf of another person you are bound to these terms and conditions as principal.
(d) We may update this terms and conditions without prior notice to you, so we recommend you revisit this page to stay abreast of any amendments. Your continued use of the Site will indicate your acceptance of any amended terms and conditions.

3. Website Images may vary.
(a) The colour, design and fit of Apparel may vary slightly from images displayed on the Site due to variances in device settings, lighting and body shape of the models depicted.
(b) Hiring Apparel from the internet is undertaken at your own risk and Never Twice is not liable for variations in the Apparel from the images on the Site that is a result of the factors referred to in 3(a) above.

4. Apparel is pre-worn.
(a) We maintain Apparel in good condition. Apparel is cleaned professionally after every hire.
(b) The Apparel is pre-worn and small, reasonable wear and tear should be expected.
(c) You may request photographs of Apparel prior to hiring.

5. When you receive the Apparel.
(a) You must keep protective ribbon / tags intact when trying on Apparel.
(b) You must not attempt to fit into or fasten Apparel that is too small for you.
(c) If the Apparel does not fit or you identify an issue with the Apparel you must notify us within 24 hours of the Apparel being delivered to you.

6. If a Piece does not fit.
(a) You must contact us within 24 hours of the Apparel being delivered to you by email to team@nevertwice.com.au or phone 1300 22 92 14. You may request:
     (i) an alternative Piece; or
     (ii) a Size Credit.
(b) We will use reasonable endeavors to provide alternative Pieces. Subject to Apparel availability and courier availability, we will send you an alternative Piece if requested by you. Alternative Pieces are provided on the following conditions:
     (i) you pay any additional costs that apply including any additional Rental Price and delivery charges; and
     (ii) you return the original Apparel to us with protective ribbon / tags intact.
If we are unable to provide you with an alternative Piece we will give you a Size Credit.
(c) Size Credits are provided on the following conditions:
     (i) you request the Size Credit within 24 hours of delivery of the Apparel; and
     (ii) you return the Apparel to us with protective ribbon / tags intact.
(d) Size Credits will be issued within 5 business days of us receiving the unworn Apparel from you.
(e) We reserve the right to refuse a Size Credit request if in our discretion we form the view that the Piece has been worn by you.

7. Returning your piece.
(a) Apparel must be returned to us in the pre-paid express post provided to you, or in an equivalent express post envelope supplied by you.
(b) Apparel must be returned over the counter at an Australia Post outlet on or before the last day of the Rental Period. Where the last day of the Rental Period is a Sunday or a Public Holiday you must attend an Australia Post outlet the next business day or post the Apparel in a curb-side express post box (the yellow box).
(c) Apparel returned over the counter at an Australia Post outlet will be deemed returned to us at the time the envelope is scanned by Australia Post. We accept liability for Apparel lost in the post where the item was accurately addressed to us, and the Apparel is returned over the counter at an Australia Post outlet.
(d) We do not accept liability for Apparel not returned to us where the envelope is not accurately addressed to us, or when the Apparel is sent via a curb-side post box.
(e) If you do not return the Apparel on the last day of the Hire Period we will charge you the daily Rental Price for the Apparel each day that the Apparel is not received by us.

8. Delivery.
(a) You must ensure that you provide us with correct shipping details. We are not responsible for any delay, loss or damage suffered by you where you have provided incorrect shipping details.
(b) We are not responsible for items left unattended at your nominated shipping address.
(c) We are not responsible for delays or additional shipping costs incurred as a result of numerous attempts to deliver the Apparel if you are not available to accept the delivery of the Apparel in person.
(d) You must notify us of any change to the shipping details as soon as possible and at least 4 days prior to the commencement of the Rental Period.
(e) You will receive the Apparel on or before the commencement of the Rental Period.
(f) We will provide you with a full refund if the Apparel does not arrive in time for your event in accordance with clause 16 of this Agreement.

9. Try On Service.
(a) We offer a Try On Service where you can rent Apparel for a period of 2 days at the price of $30.00 per day.
(b) The Try On Service is conditional upon you making a booking to hire Apparel for an event.
(c) The Try On Service is subject to Apparel availability, and dates nominated by you are not guaranteed. Please contact us to check date availability before placing an order for the Try On Service.
(d) The availability of the Apparel for the Try On Service is not guaranteed even when the booking is processed. If a change in the availability of the Apparel arises after you book the Try On Service we will notify you.
(e) You must return it to us on the last day of the Try On Service in accordance with clause 7 of this agreement.
(f) You may request to change the Apparel for your event booking. Additional charges may apply depending on the Rental Price of the alternative Apparel.
(g) Additional Try on Services are available for the same event booking for an additional price of $20.00 per service.
(h) If you identify that the Apparel does not fit during the Try On Service and you do not wish to proceed with your booking to hire the Apparel for your event:
     (i) if the Rental Period for the Apparel commences more than 14 days from the first date of the Try On Service a refund is available to you; or
     (ii) we will provide you with a store credit where the Rental Period for the Apparel commences within 14 days from the first date of the Try On Service.
(i) Refunds and store credit provided under clause 9(e) will be issued within 5 business days of our receipt of the Apparel from you, or receipt of notification from you that you no longer wish to hire the Apparel for your event (whichever comes first).

10. Cancellation.
(a) You must notify us as soon as possible if you need to cancel the Service.
(b) Cancellations made at least 7 days before the commencement of the Rental Period are eligible for store credit to the value of the Rental Price, on the condition that we have not yet shipped the Apparel to you.
(c) Store credit or refunds are otherwise not available for cancellation of the Service.

11. Loss, theft and Non-Return.
(a) You are responsible for the Apparel once delivery has been made to your nominated address.
(b) Apparel always remains the property of Never Twice.
(c) If the Apparel is lost or stolen you must notify us immediately, and you agree to provide all of the information requested by us in relation to the loss or theft.
(d) If the Apparel is lost, stolen or not returned to us within 14 days of the last day of the Rental Period you will be charged the following in addition to the Rental Price paid by you:
     (i) late fees in accordance with these terms up to 14 days after the last day of the Rental Period; and 150% of the RRP; and
     (ii) any other fees incurred by us in accordance with clause 13(d) of this Agreement.

12. Damaged Apparel.
(a) If Apparel is damaged whilst in your possession or due to the way you packaged the Apparel when returning it to us
     (i) and the Apparel can be repaired, you will be charged the cost incurred by us in having the Apparel repaired plus 10% of the cost of the repairs; or
     (ii) if the Apparel cannot be repaired, you will be charged 150% of the RRP.
(b) Costs charged for damaged Apparel are in addition to the Rental Price.
(c) Damage includes but is not limited to stains, missing beads or other features of a Piece, broken or faulty zippers, rips, tears, fraying and burns.
(d) You must notify us of damage caused to Apparel immediately and return the Apparel to us in accordance with clause 7 of this Agreement.

13. Payment Terms.
(a) The Rental Price is payable at the time of making your booking by your chosen payment method.
(b) You authorize Never Twice to deduct or charge any amounts payable by you to Never Twice under this Agreement from or to your chosen payment method.
(c) If you default on a payment owed to Never Twice we may refuse to provide further Services to you.
(d) You will be liable to pay all expenses incurred by Never Twice arising from a default in payment by you, including but not limited to debt recovery costs, legal fees and disbursements on an indemnity basis.

14. Website Usage.
(a) We endeavor to keep information on the Site up to date, however we are not liable if information is inaccurate, incomplete or out of date. Any reliance on the information obtained on the Site is at your own risk.
(b) We may modify the content of the Site at any time without prior notice to you.
(c) There may be delays in updating the Site with Apparel availability and shipping charges, in which case we will notify you of any changes that apply to your booking.

15. Limitation of Liability.
(a) To the extent permitted by law, Never Twice will not be liable to you for direct, indirect, incidental, special or consequential damages (including loss of income, profits, business or goodwill) resulting from:
     (i) your use of the Site;
     (ii) your use of the Service;
     (iii) your reliance on information contained on the Site;
     (iv)  third party interference with the Service; or
     (v) third party interference or access to transactions made by you through the Site.
(b) To the extent permitted by law, all conditions or warranties not expressly stated in this Agreement are excluded.

16. Refunds.
(a) Refunds will be provided in accordance with the Australian Consumer Law. We will provide you with a refund if:

  • we send you the wrong Apparel and we cannot fix the error in time for your event;
  • we send you Apparel that is damaged;
  • the Apparel is not delivered to you on time for your event;
  • if you use the Try On Service and no longer wish to book the Apparel for your event and the Rental Period for the Apparel commences more than 14 days from the first date of the Try On Service; and
  • we are otherwise required by law to do so.

(b) Refunds are conditional upon the following:
     (i) you provided us with the correct shipping details, and
     (ii) you return the Apparel to us as required by this Agreement, unworn, with protective ribbon and tags intact.
(c) Refunds will be issued within 5 business days of our receipt of the Apparel to your nominated account. Funds may take longer to clear in your account depending upon your financial institution.
(d) We will not provide refunds if:

  • you change your mind and no longer wish to the use the Service;
  • the Apparel is delivered to you as requested but you do not want to wear it;
  • the Apparel has wear and tear reasonably expected of a pre-worn item; or
  • the Apparel colour or fit differs slightly to the images displayed on the website but is the item that you booked.

17. General.


(a) We may assign any of our rights and obligations under this Agreement without your consent or prior notice to you.
(b) A failure or delay in exercising any right or power under these Terms is not a waiver of that right or power and does not preclude the right or power from being exercised.
(c) If a provision of these Terms is determined by a court or other competent authority to be unlawful and/or unenforceable the other provisions will continue in effect. If any unlawful and/or unenforceable provision would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect.
(d) These terms and conditions will be governed and construed in accordance with the laws of New South Wales, Australia and any disputes relating to these Terms will be subject to the exclusive jurisdiction of the New South Wales courts and tribunals.
